Disclaimers and Terms of Use / Conditions

Last Updated: August 13, 2026

Thank you for visiting the website of Medina Law Offices, P.A. These Disclaimers and Terms of Use (the "Terms") govern your access to and use of https://www.medinalawoffices.com and any webpage, form, portal, or other online feature maintained by MLO that links to these Terms (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

IMPORTANT - NO ATTORNEY-CLIENT RELATIONSHIP IS CREATED BY USING THIS SITE

Viewing the Site, submitting a form, sending an email, text message, WhatsApp message, or other communication to MLO does not by itself create an attorney-client relationship. MLO becomes your attorney only after the firm expressly agrees to undertake the representation, typically through a written engagement agreement. Do not send confidential or highly sensitive information until representation has been confirmed or MLO has specifically requested the information through an appropriate channel.

1. Acceptance and Scope of These Terms

These Terms apply to your use of the Site and its content, including text, graphics, photographs, videos, downloads, forms, links, and other materials. Separate written agreements may govern legal services provided by MLO. If these Terms conflict with a signed engagement agreement governing an attorney-client relationship, the engagement agreement and applicable professional rules control with respect to that representation.

2. Changes to These Terms

MLO may update, modify, or revise these Terms from time to time. Changes become effective when posted on the Site with an updated "Last Updated" date. Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

3. Privacy Policy

Our Privacy Policy, as posted on the Site, explains how MLO may collect, use, disclose, and protect personal information. The Privacy Policy is incorporated into these Terms by reference. Please review it together with these Terms.

4. Electronic and Consumer Communications

By providing your telephone number, email address, or other contact information to Medina Law Offices, P.A. ("MLO"), and by initiating or requesting communication with MLO - including by telephone, website form, email, text message, SMS, WhatsApp, social media, or other electronic means - you acknowledge and expressly consent to receive communications from MLO that are reasonably related to your inquiry, requested consultation, potential or existing legal matter, or relationship with the Firm.

Such communications may include, without limitation, responses to your inquiry, consultation scheduling and reminders, intake communications, requests for information or documents, case or matter updates, appointment notifications, customer-care communications, billing or administrative communications, secure links for e-signing documents, and other communications reasonably related to services you have requested from MLO.

Communication Channels, Charges, and Frequency

MLO may communicate with you by telephone call, SMS/text message, email, WhatsApp, or other communication method using the contact information you provide to us. Message and data rates may apply. Message frequency varies. If you have questions about your text or data plan, contact your wireless provider.

SMS/Text Message Opt-Out and Assistance

For SMS/text messages, you may opt out at any time by replying STOP. After a valid STOP request, MLO may send a confirmation message that you have been unsubscribed from that SMS program. For assistance, reply HELP or contact MLO at (305) 427-4892 or info@medinalawoffices.com. A request to stop SMS communications will be honored in accordance with applicable law and may limit MLO's ability to communicate with you through that particular channel. Where appropriate, MLO may continue communicating with you through another authorized method.

Wireless Carrier Notice

Wireless carriers are not liable for delayed or undelivered messages.

IMPORTANT: Consent Notice

Consent to receive communications is not a condition of retaining MLO or purchasing legal services.

Marketing and Promotional Communications

This communications consent applies to non-promotional communications reasonably related to your inquiry, requested services, or relationship with MLO. It does not constitute consent to receive unrelated advertising, marketing, or promotional text messages where separate consent is required by applicable law. If MLO sends marketing or promotional communications, MLO will provide any notices, consent mechanisms, and opt-out instructions required by applicable law. MLO does not sell mobile telephone numbers, SMS opt-in consent information, or WhatsApp opt-in consent information for third-party marketing purposes.

Call Recording, Preferences, and Privacy

Telephone calls with MLO may be recorded or transcribed where permitted by law for quality assurance, training, security, documentation, or service purposes. You may withdraw or modify your communication preferences at any time by contacting MLO. For information regarding MLO's privacy practices, please review our Privacy Policy at https://medinalawoffices.com/privacy.

5. Eligibility

The Site is intended for adults who can legally use the Site and, where applicable, enter into binding agreements. If you are under the age of legal majority where you live, you should use the Site only with the involvement and supervision of a parent or legal guardian.

6. Content Is for General Information Only - Not Legal Advice

The Site provides general educational and informational material only. Nothing on the Site constitutes legal advice, creates a legal opinion concerning your particular circumstances, or should be relied upon as a substitute for advice from a lawyer who has reviewed the specific facts of your matter and the law applicable to your jurisdiction.

Laws, regulations, court decisions, agency policies, filing requirements, deadlines, and legal procedures change and may vary substantially by jurisdiction and by case. Although MLO may update Site content from time to time, we do not guarantee that every page reflects the most recent legal development. You should not act or refrain from acting solely because of information found on the Site.

7. No Offer of Representation; No Attorney-Client Relationship

The Site is not an offer by MLO to represent you in any matter. A communication through the Site or with MLO does not establish an attorney-client relationship, fiduciary relationship, or other professional relationship unless and until MLO has expressly accepted the representation. MLO may decline a matter for any lawful reason, including conflicts of interest, jurisdictional limitations, case evaluation, workload, or other professional considerations.

Until MLO confirms representation, communications may not be protected by the attorney-client privilege and confidentiality cannot be guaranteed. Prospective-client information may nevertheless be handled in accordance with applicable professional obligations.

8. State and Jurisdictional Laws Vary

MLO may publish information concerning laws or procedures from one or more jurisdictions. Legal rights, deadlines, remedies, damages, evidentiary standards, administrative procedures, and professional requirements vary by state and federal jurisdiction. Information describing a rule in one jurisdiction should not be assumed to apply elsewhere.

Statutes of limitation, contractual notice requirements, administrative deadlines, and government-claim notice provisions can impose short and strict deadlines. If you believe you may have a legal claim or immigration, injury, civil, or other legal issue, you should promptly consult qualified counsel regarding your specific circumstances.

9. Attorney Advertising and Prior Results

The selection of an attorney is an important decision and should not be based solely upon advertisements, marketing materials, testimonials, prior results, awards, ratings, photographs, videos, or other promotional content. You should carefully evaluate an attorney's qualifications and suitability for your particular legal matter.

No Guarantee of Results

Every legal matter is different and must be evaluated based upon its own particular facts, circumstances, applicable law, available evidence, insurance coverage, parties, jurisdiction, and other relevant considerations. Any verdicts, settlements, case results, representative matters, client experiences, or other outcomes referenced by Medina Law Offices, P.A. ("MLO") are provided for informational purposes only. Prior results do not guarantee, predict, or imply a similar result in any future matter. Prospective clients may not obtain the same or similar results. Nothing contained in an advertisement or other communication by MLO constitutes a guarantee, warranty, prediction, or representation concerning the outcome or value of any particular legal matter.

No Comparison or Guarantee of Quality

Unless expressly and objectively stated otherwise, MLO does not represent that the legal services offered by the firm are superior to, greater than, or more effective than legal services provided by other qualified attorneys or law firms. Descriptions of MLO's attorneys' experience, background, admissions, practice areas, or professional accomplishments are intended to provide factual information concerning the firm and should not be interpreted as a guarantee of any particular result.

Specialists and Experts

A reference to an attorney's experience or concentration in a particular area of law should not automatically be interpreted as a representation that the attorney is a board-certified specialist or expert. Unless expressly stated together with the applicable certifying organization and area of certification, no representation is made that an MLO attorney is board certified in a particular field of law.

Simulations, Actors, Reenactments, and Dramatizations

Advertisements and promotional materials produced or published by MLO may contain actors, models, stock photographs, stock video, simulations, reenactments, dramatizations, fictional scenarios, illustrative depictions, or other creative elements. Unless expressly identified as an actual client, attorney, employee, accident, event, courtroom proceeding, medical treatment, immigration proceeding, settlement, or other actual occurrence, persons, scenes, conversations, accidents, injuries, court proceedings, negotiations, interactions, documents, vehicles, locations, and events depicted in advertising may be fictional, simulated, recreated, or dramatized for illustrative purposes. Where required by applicable law or professional rules, advertisements containing such material will include a clear and conspicuous disclosure such as "DRAMATIZATION," "SIMULATION," "ACTOR PORTRAYAL," "NOT AN ACTUAL CLIENT," "NOT AN ACTUAL EVENT," or similar language appropriate to the content being depicted. The use of an actor, dramatization, reenactment, simulation, image, sound effect, visual effect, or fictional scenario does not represent or imply that the depicted event occurred, that the depicted person is an actual client of MLO, or that a prospective client should expect the same or a similar experience or outcome.

Testimonials and Endorsements

Any client testimonial or endorsement used by MLO reflects the experience and opinion of the person providing it, subject to applicable professional and advertising rules. Testimonials are not guarantees, warranties, or predictions of future results. Prospective clients may not obtain the same or similar results. Every matter depends upon its unique facts, applicable law, jurisdiction, evidence, and circumstances. Actors or other persons appearing in advertisements will not be presented as actual clients providing testimonials when they are not actual clients. When an actor or model portrays another person, MLO will provide any disclosure required by applicable law or professional rules.

Advertising Across Multiple Jurisdictions

MLO attorneys may be licensed or otherwise authorized to practice in multiple jurisdictions. Advertising distributed through the internet, social media, television, radio, streaming platforms, or other media may therefore be accessible in jurisdictions in which a particular MLO attorney is not licensed or in which MLO does not maintain an office. An advertisement should not be interpreted as an offer or representation that MLO or any particular MLO attorney is authorized to practice law in every jurisdiction in which the advertisement may be viewed. Legal services will be provided only where MLO or the attorney providing the services is appropriately authorized to do so, including through admission, applicable federal practice authority, temporary admission, association with appropriately licensed counsel, or another authorization permitted by applicable law and professional rules. Where appropriate, and subject to applicable law and required client consent, a matter may be associated with, jointly handled with, or referred to another attorney or law firm authorized to practice in the applicable jurisdiction.

Attorney Fees and Costs

Attorney fees and costs depend upon the type of matter, applicable jurisdiction, applicable professional rules, and the written agreement between MLO and the client. Where MLO offers representation on a contingency-fee basis, the applicable fee arrangement will be governed by the written fee agreement and applicable law and professional rules. No statement concerning attorney fees should be interpreted as modifying the terms of an executed engagement or fee agreement. Where applicable, clients may remain responsible for certain costs, expenses, liens, obligations, or in limited circumstances permitted by law, fees or costs assessed in favor of another party. The applicable engagement agreement will govern the financial terms of the representation.

No Attorney-Client Relationship Created by Advertising

Viewing an MLO advertisement, visiting the MLO website, following or interacting with an MLO social-media account, watching an MLO video, calling the firm, sending a direct message, email, text message, WhatsApp message, or submitting an online inquiry does not by itself create an attorney-client relationship. An attorney-client relationship is established only after MLO agrees to undertake the representation and any required engagement documentation has been completed.

General Advertising Notice

Advertisements and promotional communications by MLO are intended to provide general information about the firm and its legal services. They do not constitute legal advice regarding any particular person, claim, case, transaction, immigration matter, dispute, or jurisdiction. No advertisement should be relied upon as a substitute for individualized legal advice concerning your particular facts and circumstances.

10. Attorneys, Co-Counsel, and Referral Counsel

MLO attorneys may be licensed in one or more jurisdictions, but not every attorney is licensed in every jurisdiction. Legal services will be provided by attorneys who are licensed or otherwise authorized to handle the matter in the applicable jurisdiction. When appropriate, and subject to applicable law and professional rules, MLO may consult with, associate, or refer matters to other attorneys or law firms. Any required client consent concerning co-counsel, referrals, or fee sharing will be obtained as required by applicable law and professional rules.

11. No Medical, Financial, or Other Professional Advice

Any Site content discussing injuries, medical treatment, insurance, damages, finances, taxes, business matters, or other professional subjects is general information only and is not medical, financial, tax, accounting, or other professional advice. You should consult the appropriate qualified professional regarding decisions in those areas.

12. License to Use the Site

Subject to these Terms, MLO grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for lawful personal or internal informational purposes. No ownership interest in the Site or its content is transferred to you.

13. Ownership and Intellectual Property

Unless otherwise indicated, the Site and its original content, design, text, graphics, logos, photographs, videos, downloads, compilations, and other materials are owned by or licensed to Medina Law Offices, P.A. and are protected by applicable copyright, trademark, trade dress, and other intellectual-property laws. "Medina Law Offices," "MLO," firm logos, slogans, and related branding may be trademarks or service marks of MLO.

Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, republish, distribute, modify, display, transmit, sell, license, create derivative works from, or commercially exploit Site content without prior written permission from MLO or the applicable rights holder.

14. Prohibited Uses

You agree not to use the Site in a manner that is unlawful, fraudulent, abusive, disruptive, or harmful to MLO, its clients, other users, or third parties. Without limitation, you may not:

  • attempt to gain unauthorized access to the Site, accounts, servers, systems, or networks;
  • introduce viruses, malware, malicious code, automated attacks, or other harmful technology;
  • scrape, harvest, crawl, or systematically extract Site content or personal information except as permitted by law or written authorization;
  • interfere with security features, access controls, Site operation, or another person's lawful use of the Site;
  • submit false, deceptive, defamatory, threatening, harassing, obscene, infringing, or unlawful content;
  • impersonate another person or misrepresent your identity, authority, or affiliation; or
  • use MLO names, logos, content, or branding in a manner that suggests endorsement, affiliation, or authorization without written permission.

MLO may suspend or block access to the Site when reasonably necessary to protect the Site, the firm, clients, users, systems, or legal rights.

15. User Submissions

You are responsible for information, documents, messages, images, or other materials you voluntarily submit through the Site ("Submissions"). You represent that you have the right to provide the Submission and that doing so does not violate law or another person's rights.

Submissions made for the purpose of seeking or receiving legal services are not treated as public content and will be handled in accordance with applicable law, professional obligations, the Privacy Policy, and any applicable engagement agreement. MLO does not claim ownership of client documents or confidential legal communications merely because they are transmitted through the Site.

16. Confidentiality and Security of Electronic Communications

Internet, email, text message, WhatsApp, web forms, and other electronic communications involve security risks. Although MLO uses reasonable safeguards, no electronic transmission or storage system can be guaranteed to be completely secure. Before an attorney-client relationship is established, you should avoid transmitting Social Security numbers, passwords, full financial account numbers, original medical records, or other highly sensitive information unless MLO specifically requests it through an appropriate channel.

17. Third-Party Websites, Services, and Platforms

The Site may link to or integrate third-party websites, maps, payment services, social-media services, messaging platforms, scheduling tools, analytics services, or other external resources. MLO does not control and is not responsible for the availability, content, security, privacy practices, accuracy, products, or services of third parties. A link or integration does not necessarily imply sponsorship, endorsement, or affiliation. Your use of third-party services is subject to their own terms and policies.

18. Site Availability; Accuracy; No Warranties

MLO may change, suspend, restrict, or discontinue all or part of the Site at any time. The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, MLO disclaims warranties of any kind, express or implied, concerning the Site, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, and freedom from harmful components.

MLO does not warrant that the Site will be error-free, continuously available, secure, or suitable for any particular purpose, or that defects will always be corrected. Your use of the Site is at your own risk.

19. Limitation of Liability

To the fullest extent permitted by applicable law, MLO and its officers, directors, attorneys, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to your use of, inability to use, or reliance on the Site or any third-party site linked from it, including loss of data, revenue, business opportunity, or goodwill.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and nothing in these Terms limits duties or remedies arising from an established attorney-client relationship that are governed by applicable law, professional rules, or a written engagement agreement.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless MLO and its officers, directors, attorneys, employees, agents, contractors, and service providers from third-party claims, liabilities, losses, damages, and reasonable costs arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person's rights. This provision does not apply to the extent prohibited by law and does not alter duties arising from an attorney-client relationship.

21. Copyright and Claims of Infringement

MLO respects intellectual-property rights. If you believe material appearing on the Site infringes your copyright or other intellectual-property rights, please contact MLO using the information below and identify the work at issue, the allegedly infringing material, your contact information, and the basis for your request. MLO may request additional information reasonably necessary to evaluate the claim.

22. Accessibility

MLO seeks to make its Site reasonably accessible and usable. If you encounter an accessibility or usability issue, please contact us at info@medinalawoffices.com or (305) 427-4892 and identify the page or feature involved so that we may review the issue.

23. Governing Law and Venue

These Terms and disputes concerning use of the Site are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law applies. To the extent a dispute concerning the Site may properly be brought in court and is not governed by another written agreement, the parties consent to the jurisdiction of the state courts located in Miami-Dade County, Florida, and the federal courts having jurisdiction over Miami-Dade County, subject to applicable law.

24. Severability; Waiver; Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. MLO's failure to enforce a provision is not a waiver of the right to enforce it later. These Terms, together with the Privacy Policy and other policies expressly incorporated by reference, constitute the agreement governing use of the Site; however, they do not replace or modify a separate written engagement agreement governing legal representation.
